The IAFD report on Audrey Mestre’s fatal accident has not yet been released, and may, indeed be withheld for some time. Release of the report may have been complicated by the lawsuit filed by the IAFD , Pipin, and IAFD President Carlos Serra on November 15 in Florida state court, naming Ricardo Hernandez and S.A.F.E.R. as defendants.
The suit, alleging invasion of privacy, unauthorized publication of name, false light, intentional infliction of emotional distress and defamation, seeks injunctive relief and unspecified monetary damages. According to attorneys for the plaintiff, the defendants filed a motion requesting an extension of time to respond to the suit, and IAFD counsel entered into agreement with the defendants for an order. The extended deadline for the defendants’ response is now set to the end of this month.
It is likely, under these circumstances, that counsel for both sides would advise their respective clients to refrain from public comment on this matter.
